<![CDATA[From <b><a href="http://www.sandiego.gov/mayor/news/index.shtml">Mayor Jerry Sanders</a></b>:<br /><b><br />Judge Cites City Attorney's Poor Legal Advice in Setback of Voter-Mandated Government Reform</b><br /><i>Mayor Vows To Push Managed Competition Forward Despite Ruling </i><br /><br />A ruling by the state Public Employee Relations Board on procedural issues related to the implementation of managed competition will set back the voter-approved government efficiency initiative by at least several months.<br /><br />More than 60 percent of San Diego voters approved Proposition C in November 2006, giving Mayor Jerry Sanders the mandate to streamline city government by allowing the private sector to compete with city employees for contracts to deliver certain city functions.<br /><br />Defying the overwhelming support of voters for the program, city employee unions have sought to thwart the implementation of managed competition through a series of delay tactics. In one such move, the unions filed a charge with the Public Employee Relations Board, or PERB, arguing that the City violated negotiating procedures on the program's guidebook and implementing ordinance.<br /><br />The city's actions were based on legal advice by City Attorney Mike Aguirre on its procedural obligations during negotiations - advice that proved to be flawed. Specifically, the PERB administrative law judge's ruling cites a poorly reasoned interpretation of the law governing negotiations with union-represented employees.<br /><br />Aguirre insisted there was no requirement for the city to bargain or hold an impasse hearing when it failed to reach resolution of disputed items with unions: "The City Attorney made clear, of course, that in his view, there was no duty to bargain. ... I have concluded otherwise," the judge wrote in his ruling. "Unfortunately, the City Attorney's advice helped to make sure that no proper impasse hearing occurred."<br /><br />"This setback underscores our desperate need for competent legal counsel in the city attorney's office," said Mayor Jerry Sanders. "This procedural ruling is a defeat for taxpayers and further delays implementation of a program that voters in the city of San Diego have made very clear they want and expect."<br /><br />The mayor intends to brief City Council in closed session on Sept. 2 on the city's strategy<br />for moving managed competition forward in light of the unfavorable ruling. Regardless of the<br />path the mayor and Council choose, the ruling is expected to delay putting services out to bid by several months at a minimum.<br /><br />"It's extremely disappointing that the city attorney's poor advice has set back so much of the progress we've made on this initiative," Sanders said. "But make no mistake: We will implement this reform on behalf of the vast majority of San Diego voters who supported it."<br /><br /> ]]>

            <title>The Tri-City Hospital Bond</title>

<![CDATA[<p>From newspaper reports it looks as though the <a href="http://www.nctimes.com/articles/2008/08/26/news/coastal/oceanside/z69b081946adc7cf0882574b200008a93.txt">Tri-City Hospital bond is going to fail</a>, for the 3rd time, after running virtually unopposed. I was hoping Escondido Councilwoman, and fellow blogger, Marie Waldron would cover this because she is a bigger expert in the reason for the failure: illegal immigration.</p>
<p>&nbsp;</p>
<p>To the Tri-City Hospital campaign team: we've all been to north county hospitals. We've all seen that the emergency rooms are full of who many people would guess are in some number illegal immigrants. You need to address that issue. There is no way north county voters are going to pass a multi-billion dollar property tax to fund more services for illegal immigrants. You need to work with the federal government and local law enforcement to deal with the problem or face the fact that the bond will never pass.</p>
<p>&nbsp;</p>
<p>Some thoughts? I'm sure it would not be possible, or even a good idea, to refuse emergency service to anyone. But can you make it public how many non-citizens are using your hospital. You don't even have to link this to specific people. Just keep records and make them public. The state refuses to disgorge these kind of numbers. Just the simple records being made public would be worth the tax increase, since it might trigger some action out of the state or federal government. Don't know who is illegal? I doubt that very much. I have friends and relatives who work for hospitals and they appear to know. But even if you can't figure it out, or don't want to, there are other statistics that would amount to the same thing.</p>
<p>&nbsp;</p>
<p>Further, perhaps it would be a good idea if you identify someone who does not need emergency care, that you ask them to leave. We all know illlegal immigrants use the emergency room for non-emergency treatment. </p>
<p>&nbsp;</p>
<p>On the other hand you can shut your hospitals down. Not good for any of us of course. Not good for you and your rather large salaries either. </p>]]>

<p>There could be more but you get the idea... this is a council in flux. My views on the candidates:</p>

<p>McCann (R running for state office): Shirley Horton (R) has held this Democrat seat for six years. Can McCann hold it? It's anyone's guess. Toss up... wild card.</p>
<p>&nbsp;</p>
<p>Castaneda&nbsp;(D incoming councilmemeber): Steve recently survived a trial, but from my conversations I'm not altogether sure he survives this fight. He has an ongoing fight with Mayor Cox, which is one thing, but an even more nasty fight with the local Republicans who are now spending big bucks down here. He was a loyal Padilla vote, and so he has a pretty bad record I would guess (think about the former Mayor's budget busting, pay for no meetings, and bodyguard). Still, no one should underestimate Steve... he is a savvy campaigner.</p>
<p>&nbsp;</p>
<p>Vinson (R running against Castaneda): with the number of candidates in the primary I have to admitt I was surprised Vinson came in first. He's proven to be a strong fundraiser with real support from the Cox people and the Republicans. I saw quite a few yardsigns in the primary around town. If you have met him you know he has an aggresive way about him and so I'm guessing he will come out swinging since Steve has problems. </p>
<p>&nbsp;</p>
<p>Bensousan (D running for the open seat): I didn't know anything about Pam before the race started, but in about 10 minutes of research I found out what I needed to know - she is a Democrat's Democrat. Endorsed by every liberal organization in the county, just about. But she'll run to the right, against the problems at City Hall I'd guess from her campaign this far. There is a rumor, though, which I can't prove, but heard from a reliable source, that she has a couple real problems that didn't come out in the primary election. </p>
<p>&nbsp;</p>
<p>Hall (R running for the open seat): Hall came real close to pulling this one off in the primary. An interesting man. If he gets to City Hall I think we are looking at a genuine independent who will do what he thinks is right no matter who he offends. He is not the best fundraiser in the city from what I can tell, but he seems to walk endlessly (or he just always looks like he walks all the time). </p>

            <title>Is it a Coincidence?</title>

<![CDATA[<span class="Apple-style-span" style="font-family: '-editor-proxy';">     As the Democratic National Convention slithers into full gear, I asked myself if it was simply a coincidence that the Discovery Channel aired the Sept.11th 2001 Documentary about the World Trade Center attacks during prime time just as Michelle Obama took the podium?  </span><div><span class="Apple-style-span" style="font-family: -editor-proxy;">     Is it a coincidence that these Dems wrap themselves in patriotism for full display while the Constitution is torn to pieces by these same people when they get back to their so-called elected posts that they've held for 30 years?<span class="Apple-style-span" style="color: rgb(0, 0, 0); font-family: Verdana; "></span></span></div><div><span class="Apple-style-span" style="font-family: -editor-proxy;">     Is it a coincidence that Obama picked Joe Biden (some 32 years in office) as his running mate, while his message of Change resonates with his supporters.  Maybe he realizes even this message rings hollow.</span></div><div><span class="Apple-style-span" style="font-family: -editor-proxy;">     Is it a mere coincidence that abortion, the 2nd Amendment and Protection of Marriage are relegated to being overlooked during the keynote speakers in favor of a more middle American message of love of country barked out amidst crocodile tears.</span></div><div><span class="Apple-style-span" style="font-family: -editor-proxy;">     What about Ted Kennedy?  Talking about turning government around.  A little to late I say, what has he been doing in Washington for a lifetime?  Shouldn't he step down and take some of the blame.</span></div><div><span class="Apple-style-span" style="font-family: -editor-proxy;">     By the way, Ted had a great opportunity in the spotlight to finally admit the errors of his and his party's ways.  Tell them Teddy, what a sham it all is.... but he will go to his grave with the joke finally on him.</span></div><div><span class="Apple-style-span" style="font-family: -editor-proxy;">     Is it a coincidence or a nightmare that so many people can be duped by a flashy smile or empty message given by elitists with no connection to the average folk?</span></div><div><span class="Apple-style-span" style="font-family: -editor-proxy;">     While it certainly is scary, this convention has to remind us how critical it is to vote our values.  Again, the makeup of the Supreme Court will depend on who we elect.  Maybe it isn't a coincidence that these speakers omit the important moral issues from their speeches.  Then their true, venomous agendas will be exposed.</span></div><div><span class="Apple-style-span" style="color: rgb(0, 0, 0); font-family: -editor-proxy;"><br /></span></div>]]>
