            <title>San Bernardino&apos;s PAL Program Disbanded?</title>

<![CDATA[<p>About 18 months ago, the San Bernardino City Council voted to allocate $75,000 to San Bernardino Police Chief Mike Billdt to start a Police Activities League.<br /><br />I heard through the grapevine that the Executive Director of the program James Frink was no longer leading the program.&nbsp; So, I submitted a public information request seeking information regarding his compensation and seeking information about Operation Phoenix disbursements.<br /><br />Unfortunately, I was not given any information about program expenditures and only received Frink's contract and payment information.&nbsp;</p>
<p>According to the information I was provided, it appears that Frink became a contract employee with the City on February 4th, 2008 and his contract was terminated on July 2, 2008.&nbsp; During this period, Frink received $20,000 in compensation (for five months worth of work).<br /><br />Apparently, nobody is leading the program.&nbsp; At least, I haven't seen any media coverage of the program and its continued existence.<br /><br />So, what do taxpayers have to show for this program?&nbsp;&nbsp;From my understanding, a couple of field trips to amusement parks.</p>

            <title>Paper or Plastic? I know let&apos;s tax both!</title>

<![CDATA[<p>Paper or plastic? </p>
<p>Let's tax both! That is of course the proposal AB 2769 by Assemblyman Lloyd Levine. San Bernardino lawmakers will make key votes on this issue in the near future.</p>
<p>The claim is that Californians don't recycle bags enough. People have proved that they will recycle when the option is available.</p>
<p>Recycling plastic bags makes sense because plastic bags make sense.&nbsp; They are inexpensive and convenient, and most Californians prefer them.&nbsp; People reuse plastic bags around the house and in the yard.</p>
<p>Paper bags are reused by Californians everyday.</p>
<p>Unfortunately, AB 2769, proposed by Assembly Member Lloyd Levine, would tax paper&nbsp;AND plastic bags.&nbsp; Just what California needs with economic growth already slowing: new and higher taxes!</p>
<p>Certainly&nbsp;we can't afford another tax.&nbsp; Since the levy would be imposed on bags used at grocery stores, it is essentially a food tax.&nbsp; But food prices have been rising sharply, as well as the cost of gas, making every trip to the supermarket more expensive.</p>
<p>This burden would fall most heavily on those who can least afford it--both poor and larger families.&nbsp; The per bag fee might not seem like much, but it would add up over the year.&nbsp; And for many families in today's uncertain economic times, any cost increase is too much.</p>
<p>AB 2769 would also impose new, and frankly unrealistic, waste diversion targets for plastic bags.&nbsp; The state also would have to enforce this dictate and collect the new tax with more bureaucrats of course.</p>
<p>AB 2769 is bad tax and a bad idea. The legislature or Governor should bag it!</p>

            <title>Prop 6 - What it does to make our communities safer</title>

<![CDATA[A few days ago, I received a request for more information about what Prop 6 does. &nbsp; I would have gotten this up sooner, but as a government employee, I only post after hours (or before as I am this morning...have to rush as I've got 7 minutes until I'm late for work.)&nbsp; As many of you are aware, Prop 6: The Safe Neighborhoods Act is a compilation of many of the common sense public safety bills that San Francisco and LA based Democrat legislators have blocked from getting out of the Public Safety Committees in Sacramento.&nbsp; San Bernardino leaders Senator George Runner and Supervisor Gary Ovitt decided to do something about it, and put together this proposition.&nbsp; Rather than reinvent the wheel, bellow is the summary of what the Proposition does from the campaign website:&nbsp; <a href="http://www.safeneighborhoodsact.com/">www.safeneighborhoodsact.com</a><br /><br /><blockquote>The Safe Neighborhoods Act is a comprehensive criminal penalty and
public safety funding initiative that targets criminal street gangs,
felons with guns, and drug dealers with focused penalties, and provides
sustainable funding to our local police, sheriffs, and prosecutors. It
also increases public accountability for gang intervention and
prevention programs.</blockquote>
<p><em><strong><u>Public Accountability:</u></strong></em></p>
<ul><li>Creates an early intervention accountability commission
to evaluate early intervention and rehabilitation programs for gangs to
emphasize what programs are effectively spending public funds, and what
programs are wasting tax dollars so that they can be eliminated.&nbsp;
Taxpayers deserve this type of accountability.</li></ul>
<p><em><strong><u>Dangerous Illegal Immigrants:</u></strong></em></p>
<ul><li>Prohibits illegal immigrants, who are arrested for
violent felonies or gang crimes, from being released on bail or on
their own recognizance without a judicial hearing.</li></ul>
<p><strong><em><u>Criminal Penalties on Gangs:</u></em></strong></p>
<ul><li>Imposes a 10-year penalty increase on gang offenders who commit violent felonies.</li><li>Requires
convicted gang offenders to register with local law enforcement each
year for five years following conviction or their release from custody.</li><li>Increases penalties for possession, possession for sale, and sale of methamphetamine to the same level as cocaine.</li><li>Streamlines civil gang injunction process and increases penalties for violations.</li><li>Increases penalties for multiple acts of gang-related graffiti.</li><li>Requires
that gang offenders previously convicted of car theft or joy riding be
subject to a felony penalty for any subsequent car theft or joy riding
offense.</li><li>Enhances penalties for individuals providing contraband to gang members in prison.</li></ul>
<p><em><strong><u>Section 8 Housing Compliance:</u></strong></em></p>
<ul><li>The Safe Neighborhoods Act ensures that anyone receiving
public housing benefits (Section 8) who is caught buying or selling
drugs, who is involved in gang activity, or illegally in possession of
firearms will lose their public housing benefits.&nbsp; It requires an
annual criminal background check as a condition of housing benefits.</li></ul>
<p><em><strong><u>Intervention and Rehabilitation</u></strong></em></p>
<ul><li>The measure provides funding for local law enforcement-run after school programs.</li><li>Creates a mentoring and job training program to help parolees succeed upon release.</li></ul>
<p><strong><u><em>Criminal Penalties for Illegal Guns:</em></u></strong></p>
<ul><li>Strengthens the 10-20-Life law to penalize not only
offenders who personally use firearms in the commission of certain
felonies but their accomplices as well.</li><li>Goes after cop-killers by adding 10 years to dangerous felons who carry loaded or concealed firearms in public.</li><li>Adopts "Use a gun and lose a car" - when car is used in crime, gun is in the car, and registered owner is involved.</li></ul>
<p><em><strong><u>Victim Protection:</u></strong></em></p>
<ul><li>Protects children from gang predators by increasing penalties for gang recruitment of juveniles.</li><li>Authorizes
admission of sworn statements by witnesses to gang crimes who die or
are unavailable to testify at the time of prosecution because of flight
or intimidation.</li><li>Protects victims by strengthening Department of Justice Witness Protection Program.</li><li>Establishes statewide reimbursement program for information leading to arrest or conviction of criminal offenders.</li><li>Creates a victim services website.</li></ul>
<p><em><strong><u>Community Policing</u></strong></em></p>
<ul><li>The Safe Neighborhoods Act provides the programs and resources essential to community-based policing.</li><li>Expands Neighborhoods Watch programs statewide.</li><li>Informs and involves citizens in public safety through multi-media education.</li></ul>
<p><em><strong><u>Safe Neighborhood Public Safety Funding:</u></strong></em></p>
<ul><li>Provides funding for GPS tracking equipment for monitoring gang offenders, sex offenders, and violent offenders.</li><li>Adds resources to violent gang prosecution programs at the local level.</li><li>Funding for county sheriffs for jails and gang enforcement.</li><li>Enhanced city police enforcement targeting gangs and violent crime.</li><li>Multi-agency gang taskforces and gang enforcement training for peace officers.</li><li>Resources to county probation targeting high-risk probationers with weapons and caseload ratios.</li></ul>Multi-agency narcotic taskforces with an emphasis on border interdiction.<br /><br /> ]]>

            <title>Costly Candidate Statements</title>

<![CDATA[<p>ELEVEN&nbsp;candidates have filed in the San Bernardino City Unified School District race.&nbsp; There are three seats open with one incumbent deciding not to run for re-election.<br /><br />The big news is that&nbsp;ONLY&nbsp;THREE&nbsp;candidates submitted statements that will be included in the voter materials: incumbents Danny Tillman and Judi Penman and challenger Ron Coats.<br /><br />The cost for a candidate statement for this race, a whopping $3,375!&nbsp; When I ran for the same seat two years ago, I believe the cost was just over $2,000.&nbsp; This is an exorbitant cost bourne by candidates.<br /><br />The cost of candidate statements is a huge advantage to an incumbent, especially in races like school board elections.&nbsp; The main special interest group for a school board election are the teachers and employees unions.&nbsp; Consequently, challengers have a huge hill to climb just to get to the starting line.<br /><br />In races such as these where there is much difficulty in raising money from private individuals, something should be done to lessen the burden on candidates.&nbsp; I find it pretty aggravating to see pages and pages of election materials printed in English and Spanish just so that a relatively few non-english reading voters aren't "disenfranchised" while substantive candidate statements are discouraged from publication due to their outlandish cost, even though they are much more widely read than the Spanish sections of the phamplets.<br /><br />I am not interested in getting into an illegal immigration debate or english-only debate.&nbsp; Empirically, I would think that even supporters of putting voting materials in Spanish can admit that the return on investment with respect to creating an informed and educated electorate is ridiculously low compared to candidate statements.<br /><br />Below are the candidate statements for the SBCUSD candidates:<br /><br />

            <title>When Does a Public Informaton Request Become a Demand?</title>

<![CDATA[<p>On July 28th, I submitted a written public information request asking for all emails sent and received by Mayor Pat Morris, Chief of Staff Jim Morris, City Manager Fred Wilson and Code Director Glenn Baude between June 27th and the date of the request.<br /><br />Just before the 10 day deadline, I received a letter from Lori Sassoon, Assistant City Manager.&nbsp; She stated that due to volume of the documents requested, they would need the extra 14 days they are entitled to, to fulfill the request.&nbsp; According to the letter, I would be allowed to view the documents on Thursday, August 21st.<br /><br />Due to the anticipated number of pages, I called Sassoon late Wed. afternoon to ask when they documents would be ready so that I could plan my day and allow myself enough time to view the documents.&nbsp; Unavailabe, I left a message.<br /><br />On Thursday morning, I spoke to a staffer in the City Manager's office and was told that the documents would be ready by 4pm.&nbsp; Early that afternoon, a staffer from the City Attorney's office called to tell me that unfortunately, they were running behind on&nbsp;processing the request and that it would most likely be ready on Friday.&nbsp; After he told me he would check in on the matter, I asked him to give me a call back later that day, so that I could plan my Friday to view the documents.<br /><br />Late Thursday, I&nbsp;was called back and told&nbsp;by the same staffer that the request would not be ready until early next week.<br /><br />I&nbsp;queried and pressed for definitive answers and clarifications.&nbsp; Unfortunatley, he&nbsp;did not have a concrete time and stated that the documents needed to be reviewed by City Attorney Jim Penman to&nbsp;make sure that I did not receive any emails that were required to be redacted.<br /><br />I&nbsp;left a message and asked for Mr. Penman to give me a call to discuss.<br /><br />This afternoon, I walked into the City Attorney's office and was told that I might be able to get them on Wednesday, but nothing was guaranteed.&nbsp; To date, I have not received a call from Mr. Penman, nor do I have any&nbsp;definitive&nbsp;date as to when I will be able to view these documents.&nbsp; <br /><br />What recourse does&nbsp;the average Joe Schmoe citizen have when it comes to public information requests?&nbsp; Here&nbsp;I am sitting on day 28..going on 29...of a public information request that has yet to be filled.<br /><br />What can I do?&nbsp; Take legal action?&nbsp; How long will it&nbsp;take to get&nbsp;that ball rollin...&nbsp;&nbsp;Unfortunately, this isn't the first time I have been stymied by the City Attorney's office in a public information request.</p>
<p>It is frustrating&nbsp;and exasperating...</p>
<p>So, what can I do, other than grin and bear it?</p>
<p>It may be petty and juvenile, but the only thing I can think of is to flood the office with additional public information requests.&nbsp; So, today I submitted another request for all emails between the same individuals between March 1st and June 27th.<br /><br />I suppose that&nbsp;if I do not&nbsp;get the information by Wednesday, I will submt another request&nbsp;for more emails going back to the first of&nbsp;the year and keep tacking on requests for more information.&nbsp;&nbsp;Perhaps, the city should hire another employee just to handle my information requests since it takes a month to get one processed.</p>
<p>God knows, San Bernardino has plenty of money to burn.&nbsp; After all, we are&nbsp;paying an Interim Director of Code Enforcement $65 an hour, while the Director is&nbsp; on paid leave and the&nbsp;Assistant Director is&nbsp;apparently unqualified to "mind the store".&nbsp;</p>]]>

            <title>CEO Praises SB County Employees</title>

<![CDATA[<p>This letter was put up on <a href="http://www.insidesocal.com/newsroom/2008/08/letter_from_jack_brown_in_prai.html#comments"><strong>Steve Lambert's Blog</strong></a>- who is the Editor of the Sun.<br /><br />Apparently, he recieved the letter&nbsp;from Jack Brown, the CEO of Stater Brothers.&nbsp; It was very nice of Mr. Brown to write this letter on behalf of the many of us whom agree.&nbsp; <br /><br />While there has been much corruption and controversy lately with a select few County individuals, their behavior and ethics&nbsp;do not reflect the rest of the County employees.&nbsp; It's unfortunate how the&nbsp;recent scandals bring about negative connotations of our County and its' dedicated employees because of the wrongdoings of a few.&nbsp;&nbsp;<br /><br />Here's Mr. Brown's&nbsp;letter:</p>

<p><br />I am the son of a former San Bernardino County worker. My father spent his entire adult life serving the citizens of San Bernarino County for over 27 years until his untimely death.<br /><br />He was so honored to serve the Citizens of San Bernardino County as chief deputy sheriff and proud to work for the citizens of the county.<br /><br />But I am very concerned by the newspaper headlines I read far too often, that tells the story of another betrayal of our trust by a county worker who has been indicted, convicted, and/or sentenced for crimes against our county.<br /><br />But these wrongdoers are very few, only a handful, of the over 12,500 outstanding county workers who work hard and honestly to serve us every day.<br /><br />I am concerned that some will judge our over 12,500 terrific county workers by the actions of a very few.<br /><br />County workers not only perform services daily that keep our county running smoothly, but they are also the first to volunteers to be Little League coaches, volunteers, choic teachers, choir members and oh yes ... did I mention how generous they are with their personal money and time as they contribute to local United Ways in their annual fund raisers.<br /><br />So let us tell every county worker we know or come in contact with how proud we are of them and their co-workers.<br /><br />Make no mistake ... America's largest county is served by America's best county workers.&nbsp;</p></blockquote>]]>

            <title>Fiscal Discipline Requires Us to Reject More Borrowing</title>

Why, then, should we think that collectively, as a nation, we're not bound by the same limitation? We must act today in order to preserve tomorrow. And let there be no misunderstanding - we are going to begin to act, beginning today."<br /><br /></em><strong>First Inaugural Address by Ronald Reagan<br />Washington D.C. - January 20th 1981<br /></strong><br />As the state budget becomes 50 days past due, it is no surprise that pressure is building in some quarters to adopt a budget that doesn't meet our long-term needs and continues to rely on "quick fix" schemes that actually deepen our structural deficit. Any Californian can describe to you the folly of paying off one credit card with another--yet surprisingly that is exactly what some of my colleagues are beginning to talk about. <br /><br />State government excels at short-term borrowing. We know how to "borrow" from our own special funds. We know how to "borrow" from dedicated funds for local government. We know how to "borrow" from dedicated transportation funds. The fact we can do it does not make it right or responsible. In fact, it is the height of irresponsibility.<br /><br />There is no better time than now to commit to fiscal discipline. As President Reagan called us to do in 1981, our party naturally unites around conservative fiscal practices because it's the right thing to do and because it's why the voters sent us here. It is our Republican party that has had a historical disdain for huge debt and government borrowing - and it is those principles that we must recommit to if we are to secure genuine structural budget reform.<br /><br />The first thing any credit counselor tells a family in serious debt it needs to do is to "cut up the credit cards." The state of California needs to heed the same advice. Moreover, we also need to adopt budget reforms that prevent us from getting into this type of problem again--like budget and spending reforms that require that we restrict spending and maintain reserves sufficient to weather the next economic downturn. <br /><br />As the former mayor of Yucca Valley, our city council and staff worked each year as a team to balance the city budget and maintain reserves so we maintained service levels and didn't have wild fluctuations in local taxes and fees as the economy changed. I want the same thing for our state, and I want to end our senseless and destructive dependency on using the funds of local governments to pay for the obligations of the state of California (whether we take them outright or "borrow" them). <br /><br />It is time for real budget reform in order to end the "band-aid and baling wire" solutions of the past. We must implement the common-sense practices of money management and check balancing that every sensible Californian practices on a daily basis. We should cut up our credit cards and finance our day-to-day expenses on a cash basis with state (not local) funds--just like a well managed local government, family or business. <br /><br />It is time to fix this system once and for all. Now is the time and this is the place.</p>]]>

            <title>Prop 6 Earns Universal Support from CA Sheriffs</title>

<![CDATA[<p>As Election Day approaches, endorsements from law enforcement continue to pour in for Prop 6, the Safe Neighborhoods Act. <br /><br />In fact, Prop 6 has the support of every California sheriff - from San Diego County to Del Norte County. In the most recent op-ed published by the Modesto Bee last week, Stanislaus County Sheriff Adam Christianson said:</p>
<blockquote dir="ltr" style="MARGIN-RIGHT: 0px">
<p><br /><br />"Whether California faces good or challenging economic times, we must always make public safety our number one priority. If our streets, parks and schools aren't safe from gang violence and other crimes, then nothing else really matters."<br /></p></blockquote>
