Senate Judiciary Committee Recognizes UC Irvine Anti-Semitism

Posted by: Jonathan Constantine | 03/08/2008 9:35 PM

Update (3/14/2008, 2:14pm): Specification Underlined.

In an interesting turn of events, the US Senate Judiciary Committee has now decided to weigh in on the issue of antisemitism at UC Irvine. In a letter to the US Secretary of Education Margaret Spellings (signed only by Republican Senators Jon Kyl, Sam Brownback, and Arlen Specter) , certain members of the committee demand that the Office of Civil Rights pursue their investigation into claims of antisemitic harassment at UCI in part because the incidents on campus fall under Title VI, of the 1964 Civil Rights Act, that is, the prohibition of national origin discrimination in programs and activities receiving federal assistance. Despite prior policy statements from the Department of Education and the United States Commission on Civil Rights, the investigation narrowly tailored the negative use of "Jewish" as a critique of religious faith rather than national origin discrimination. The dually defined term "Jewish" is also in fact supported by case law. It was affirmed by the Supreme Court as both religion and national origin in Shaare Tefila Congregation v. Cobb, 481 U.S. 615 (1987).

The letter also notes that the Department of Education failed to interview claims of antisemitism from witnesses in the report sent to them from the Zionist Organization of America.

Nevertheless, the Muslim Student Union did in fact invite speakers who targeted Jewish involvement in politics, business, and culture.  Absent was a scholarly debate on religious faith.

Three Republican senators -- Specter, Kyl, Brownback -- signed the letter. The Republicans are, of course, the minority party. The letter does not appear to be a letter on behalf of the Committee -- although, in my opinion, the Committee ought to send such a letter. Your post, as written, leads readers to think that the Democratic majority supports this letter, when in fact there is no evidence that any Democrat does. Please correct your "post."

Of course the Democratic majority doesn't support this.

Amazing that neither California Senator, Including diane Feinstein, who is Jewish (I think Barbaa Boxer is too, but I'm not sure) signed the letter. Tells you something.

It's about frikkin' time! As an aside, I was a member of Shaare Tefilah Congregation in Silver Spring, MD [Shaare Tefila Congregation v. Cobb, 481 U.S. 615 (1987)] when it was defaced by swastikas and anti-Semitic graffiti. Rabbi Martin S. Halpern refused to have the building cleaned immediately and left the graffiti up for a number of weeks so that the community could see that Jews in modern times still faced prejudice and hatred. He also was instrumental in taking the above referenced case to the Supreme Court.

Why isn't the letter signed by the committee chairman Patrick Leahy?

Amazing this is getting this far, also not surprising that the Democrats on the committee refused to sign. How much different is that from the UN Security Council being unable to pass resolution condemning the massacre of 8 students last week in Jerusalem? My comments on that incident:

How much longer will we let silence and celebration of anti-semitism continue? Why is it accepted, or ignored, under "tolerance" when we condemn racism, when we condemn sexism?

Thanking the Dhimmi Democrats ahead of time. Without their help CAIR and other Islamic front groups would never get a foothold in this once proud land.

Diane Feinstein is not Jewish. Of more note is how Stanford and UC BERkeley are inking a deal with the Sauids to hire faculty for them in creating a new unviersity overseas in the Kingdom of Hatred. That means that the Universities will be practicing racial discrimination against Jews as they will be prohibited from hiring them.
