Lincoln Club Endorse Prop. 98, Oppposes Prop. 99

This came over the transom yesterday from the Lincoln Club of Orange County:
"Proposition 99 is being funded and falsely marketed by cities and counties as the 'true eminent domain reform,'" explained Dan Baren, Lincoln Club Legislative Committee Chairman. "In fact, some of these same governments, through their redevelopment agencies, have abused eminent domain by seizing so-called 'blighted' property then, transferring them to another private owner for private uses, such as the development of big-box stores or retail projects, that generate tax revenue."
Proposition 98 protects homeowners, landowners, farmers, ranches, churches, and other property owners from the Supreme Court's recent Kelo decision, which expanded the power of government to seize private property for private use. Proposition 99 only protects single-family homeowners who have lived in their home
for one year or more from eminent domain. It also includes a 'poison pill' provision that seeks to undermine the voters will if Proposition 98 passes.
"Proposition 99 specifically states that it will trump any other eminent domain initiative if it simply gets more votes," Baren explained. "So if both Prop. 98 and 99 pass, and Prop. 99 gets one more vote than Prop. 98, then the less-protection Prop. 99, will be the law. That's why the government interest groups are trying to confuse voters by claiming 99 is 'true eminent domain reform.'"

Homeowners, farmers, and landowners get maximum protection with 98, while 99 doesn't go far enough
ORANGE COUNTY, Calif. (April 11, 2008) - The Lincoln Club of Orange County's Board of Directors voted unanimously today to endorse Proposition 98 and oppose Proposition 99, both of which will be on the June ballot.
"Proposition 98 is the true eminent domain reform initiative that provides private property owners the most protection against the ability for governments to seize the property of one private party and hand it over to another private party for the benefit of government coffers," said Richard K. Wagner, President of the Lincoln Club.

In the local section of today's OC Register is a large report of "Rezoning In Lake Forest." What is to prevent their redevelopment agency from seizing Saddleback Church property for future housing and tax generating businesses? after all, the church does not pay any taxes and they occupy some high value acreage in Lake Forest.
The answer. Prop 98. The only property rights measure on the June 3rd ballot that protects all houses of worship.

Why can't supporters of 98 just call the initative what it is?
It is an anti-rent control bill. I think it would be better for the pro campaign to come clean and support it for what it is. The 99 people will hammer at this and ignore the positive effects 98 is trying to acheive.
Just askin. Here's the Superior Court's reaction to your misinformation.
The honorable Timothy Frawley of the Superior Court of CA rejected a lawsuit by a coalition of politicians contending that Proposition 98's ballot title and summary is misleading. The court ruled with the state that the "chief" purpose of Prop 98 is to reform eminent domain abuse.
"The court rejected the attempt by opponents of Prop 98 to characterize the intitiative as merely a 'rent control' measure.
Regardless of your opinion we will still fight to protect your home, church, small business or family farm from an eminent domain "taking" for private use if you have no desire to sell.

Howard Jarvis folks were co-sponsors of prop 99 until money started coming in for them to pull out of the campaign. The money comes from apartment management firms and mobile home park landowners. Farms, churches and of course homes were a significant part of the 99 coallition.
Money has a way of changing political bedfellows, cant' think of a better example than ACA8 and 98/99
98 folks screwed up by going after rent control and 99 folks were brilliant in adding the "poison pill". I believe both initiatives will win and 99 will trump 98. Too bad these guys could not work together. ACA8 was supposed to be that joint effort.

It's nice to be able hide behind a pseudo name and make allegations for which you have not provided any proof.
This post is about Prop 98 & Prop 99. The HJTA is a major supporter of Prop 98. Period!
ACA-8 is another example that is worth commenting on as you have introduced that failed Constitutional Amendment into the discussion.
ACA-8 included protection for all small businesses up to 25 FTE's yet Prop 99 offers no such protection [to around 500,000 small businesses in CA.]
Instead of attacking the HJTA perhaps you can explain why small businesses were discounted by the League of Cities, CSAC and other supporters as you comment on property rights protections.

The "folks"at prop 99 are being investigated by the Fair Political Practices Commission...whats up with that? Do they use taxpayer money to run a campaign to take away the tax payers property rights,so they can build more big box stores and collect more tax?I guess they need more money to pay for those high paying government jobs.Prop 99 will do next to nothing...if they want your house all they need to do is rezone to business.
