California Supreme Court Will Not Review Nguyen v. Nguyen

Posted by: Tomahawk | 04/30/2008 11:14 PM

Trung Nguyen.jpgI was notified by Trung Nguyen this afternoon that the California Supreme Court just denied his petition for review.  Yes, the Nguyen v. Nguyen '07 saga is actually over.

Unlike other writers on Red County, I know Trung Nguyen on a personal level and have the utmost respect for the man.  Even though he was ultimately unsuccessful in overturning the recount result, Trung gained a lot of good friends in the process.

I'm sure this will not be the last time we hear from Trung and I wish him nothing but success in his future endeavors.

Why do we have paper ballots? said:

Everyone knew this would not change the special election results, but now that Janet's side can feel unthreatened - can we all admit it would be better public policy to count the paper ballots that come out of the electronic voting machines in a recount?

Otherwise, what the heck are they for? As a fiscal conservative, I want to know why we pay for them if we don't even use them in a recount?

Anonymous said:

Who is going to step up and pay the legal fees owed in this case?

Trung is already in massive debt from his campaign and Dina won't help him.

Heck, he couldn't even pay his own lawyer. I guess you get what you pay for.

Trung has walked away from his debts before.

How you you spell B-A-N-K-R-U-P-T-C-Y?

Anonymous said:

Trung Nguyen is an honorable man. I'm sure he will write the check for the legal fees he owes right away, if he hasn't already.

Oh, please said:

He has "gained a lot of friends" What a joke. Trung and everybody else involved in this charade have lost friends, not gained them.

Anonymous said:

Trung Nguyen is an honorable man and he doesn't own any knives to stab his friends in the back either, unlike s certain Supervisor we all know who does it repeatedly and then running around crying that she's the "victim".

Noooooooo, really? said:

You're friends with Trung, Tomahawk? Since your posts usually have a not-so-subtle anti-Janet bias, I'm shocked--shocked!

Nice job on this one, Schroeder... really nailed it.

Anonymous said:

Jesus Tomahawk (TD), can you put anymore spin on this thing? First you laud him in your post and then you have to make anonymous comments defending him? Give it up bro, Trung got iced and that's where his political career is going to stay, on ice.

The Bolsavik said:

Trung is a very nice guy who made a really bad judgment call in allowing Mike Schroeder to go down the "scorched earth" tactics against Janet.

If he had stuck with just the one appeal of the recount, that would have been a legitimate use of the court system to clarify election laws, and he wouldn't have been so derided now.

Janet has lost that Supe. election to Trung

Anonymous said:

Dear Anonymous 10:54 AM - I guess you didn't read the news, actually she won.

TD - I know how hard it is to be neutral. I suffer with the same problem.

Anonymous said:

Anon.aka Janet, Funny! Janet, having nightmares on Christmas Eve? You should......

For stealing the legit election result with Dems lawyers!

It's good to live in U.S.A......you can buy anything with little green backs ........including your Supe. seat.

Dina wiil wipe away your nightmares in coming June. Call your travel agency now for cheap ticket to Ho Chi Minh city.

Vivian Kirkpatrick-Pilger said:

Anonymous 11:42 AM. I am not Janet Nguyen. I am Vivian Kirkpatrick-Pilger for your information. And it might be time for you to take a reality test. When the election recount was done it was contested in a United States Court, actually several courtrooms. Each time your pal Trung lost. I don't know if you are aware of it or not but the judges really don't care if you are a republican or a democrat. And if you are slandering Janet Nguyen indicating that she has "bought her supervisor's seat" you might want to be hiring a lawyer to defend your self from all the accusatory and unfounded unintelligent remarks you throw out on here. Growing up might also help your case.

Anonymous said:

Anon 11:42,

Cuong Cao, you really need to mix up your writing style if you're going to try and post annonymously or else ask your wife to help with your writing. We can see through it.

Anonymous said:

Vivian, Good afternoon! How is your bogus cra chapter doing?

When a lost candidate had to resort to hiring a PAID lawyers to over turn the will of the voters.............................it's called "money at work"

Many republican voters still have great resentment against Janet for this reason alone!

Dear "CRA" (the REALLY BOGUS CRA):

You should know what bogus is..after all the CRA rules that 50% of your charter members should live in the charter area where you want your charter. Well we looked up all of your Charter members at the Registrar of Voters and guess what???? Only one or two of your original charter members lived in Westminster!!! so you got your Charter under FALSE pretenses. Two of your members were not even registered to vote! YOu filed your chapter in April of 2002 and two of your members didn't even register to vote until 2004/2005!! That's another CRA rule, you have TO BE A REGISTERED REPUBLICAN VOTER TO BE A FOUNDING MEMBER OF A CHARTER. My goodness for someone who repeats themself alot, I wonder if you can repeat this: Vivian was right, I was wrong; Vivian was right, I was wrong. Now if you do that 100 times perhaps you will be less arrogant.

Furthermore, you erroneously filed as the "ORANGE COUNTY AMERICAN VIETNAMESE CRA" did not name Westminster in your title, Yet ANOTHER RULE OF THE CRA THAT YOU BROKE.

Then as if that's not enough, you had in your ORIGINAL CHARTER "The jurisdiction of the AMERICAN VIETNAMESE REPLUBICAN ASSEMBLY shall be within the Vietnamese American Community/City of Westminster, County of Orange, STate of California as now established or hereinafter created.

So that pretty much left out the rest of the residents of Westminster UNREPRESENTED since the Vietnamese community comprises only 38% (and shrinking from what I hear...they are moving out of Westminster to get away from their overbearing elders now).

SO NOW WHO'S A SHAM CRA ???

Vivian Kirkpatrick-Pilger said:

By the way, that was my post at 3:39, forgot to put my name in the box, but I guess you know all about people forgetting to put names in boxes....LOL

The Captain said:

I wonder if you can repeat this: Vivian was right, I was wrong; Vivian was right, I was wrong. Now if you do that 100 times perhaps you will be less arrogant.

That's a pretty arrogant thing to say.

Anonymous said:

Well Captain I think he's a pretty arrogant guy, just thought it was something he might recognize.

cra republican said:

Now I understand why people don't want to associate with Vivian....

She starts every morning shouting 10 times "Vivian was right!"
............in front of her mirror.

Vivian, you can cry over and over 110 time but we still feel you are WRONG!

Vivian said:

See, that's just your problem CRA, even when presented with the facts you still think you are right and the other person is wrong. The facts are the facts. The CRA By-Laws were violated by the AVCRA in their formation and it should have been made to re-new their chapter using the rules and the right number of people living in Westminster, and calling it the right name. But instead the CRA took the short cut and just let you re-name your group to "Westminster CRA" now. I know you are proud to change your name from the American Vietnamese CRA to the Westminster CRA, and after all you have lots of members that live in Westminster NOW, but not when you got your bogus charter. At any rate that's another chapter in the story of how you manage to alienate 60 % of the town. Good going there.

cra republican said:

Vivian, allow me to add some garbage into your trash can .............you have refused to join any of the pre-existing cra units because you wanted to establish a new unit for Janet!( 5 more votes at the endorsement convention)

How you just have lied to the public by deleting all important facts.

I find you guilty and you are punishable by spending rest of your life shouting "Vivian was WRONG!" everytime before you lie!

Vivian said:

You left out a couple of important facts yourself. I have not refused to join CRA units, I was a MEMBER of the American Vietnamese CRA..and you should know this because you were there and we have talked about this many times.

Why did I quit your unit? Because a non-Vietnamese person that I know (you know who I am referring to) was appointed by you to be a delegate to a convention in Bakersfield. You told her she would be the delegate to cast votes for endorsements.

When Lou Correa left his seat, and an endorsing convention was held in Orange, Mr. Cuong Cao indicated that this non-Vietnamese person would no longer be the delegate to cast votes. At that time this delegate and myself were both in favor of endorsing Kermit Marsh. However, you replaced her with another person, a person of Vietnamese heritage. When this non-Vietnamese person asked why she had been replaced, your secretary asked you and told us that you thought because the name of the unit was the American Vietnamese CRA that a Vietnamese should be the delegate.

Feeling very discriminated against, both this other non-Vietnamese person and I declined to pay our next dues and withdrew from the AVCRA as we felt it was Mr. Cao's intention to only allow participation by Vietnamese in the OCAVCRA. So THAT IS WHY we wanted to start our own CRA.

So you may withdraw your lies now. And you know this to be fact because you were there.

cra republican said:

Vivian, one more thing........... get your facts straight!

I don"t belong to Viet/Westminster CRA chapter.

Again You could have joined any other units and you have no, zero and zip excuses other than your dirty hidden motives.

You were beaten/emotionally hurt by Truong in last election and I think your political life is basically all but finished due to your dishonest character. No one respects you Vivan, the lady fingers!!!

2:22pm

Perhaps you might want to read up a little.

TRUNG Nguyen is the one the sued Janet Nguyen.

Without TRUNG, there was no lawsuit.

Beacuse TRUNG is the plaintiff and failed, he's on the hook for legal fees.

cra republican said:

Vivian, you are still refusing to repent!

Let me offer you the poison pill..........if your motivation was purely based upon "discriminatory feeling"

Why did you try so hard to make sure that you will have pro-Janet 5 delegate votes at the cra convention?

Anonymous said:

WHY DO WE HAVE PAPER BALLOTS? SAID, 11:41 P.M.:

You ask a valid question but the printed paper ballot used in the voting booth was never intended for recounts. It was legislated to provide a verification for the voter that the electronic vote cast was who/what they intended to vote for. So the votes cast and tabulated on election night are electronic with an extra verification by the voter. This is why it was called the voter verifiable paper audit trail and not the paper audit trail used for recounts.

Has Trung Nguyen paid up, yeat?

Anonymous said:

Anon @ 7:31 AM,

Who knows and who cares. I'm not getting the money? Are you Janet?

Thanks said:

7:31 PM,

While I wish they would count the papaer ballots in a recount, your explination makes a lot of sense.

I really appreciate someone addessing the issue instead of name calling like the rest of the posts here.

Better Pay Up said:

I wonder if Trung is going to have to declare another bankruptcy to try to worm his way out of legal fees. Or maybe Dina can skim off some profits from her sham real estate business. Oh wait, she doesn't report an income. That hurts.

cra republican said:

Better pay up, I have a better idea. Let's recycle all of Janet's paper trash (credit card bills, new bridge plans, receipts for 1 million office remodeling..etc) in her office and we should have more than enough to pay for just about anything........... execpt that 2.5 million dollar bogus bridge Janet has promised.

Read today's LA Times........... thanks to wasteful minded office holders like Janet, we are definitely facing the new/ tax increases this year in California.

We are paying $4.00/gal for gasoline today and Janet wants to spend more of our tax payers money on politically induced projects serving her interest first.

Vote NO to wasteful spending Janet!

Better Pay Up said:

Cuong, you better own up to your weak excuse for an arguement. Janet Nguyen is responsible for higher taxes in CA and Janet Nguyen is responsible for high gas prices. And let me guess, you also think George Bush is a God amongst men and the greatest president we've had since Reagan. You might want to lay off eating the same paste the kids at your day care are eating.

Better Pay Up said:

And by the way, get your facts straight and stop believing your own lies about a "1 million dollar office remodel" (I cleaned up your grammar there for you. You can thank me later.) everyone knows it was no where near $1 million. Come to think of it, you may want to have the kids switch to Crayola's, the fumes from their markers might be getting to you.

cra republican said:

Better pay up......Did you forget already? Janet wants to use state's borrowed money for that $2.5 million "Golden Bridge" in Westminster.

How much did Janet's office remodeling cost our tax payers then?

Vote No on Spend Spend Janet!

Better Pay Up said:

Cuong, you really need to learn the difference between "borrowed" and "allocated". It's state allocated money. And your arguements are getting rather redundant and you're not coming up with anything new. I'm suprised your friend Student finally gave up on the "evil Janet lady" name calling.

Don't confuse Chriss Street's remodel ($1 million with Janet's). The remodel was approximately $150k, less than supposed tax defender John M.W. Moorlach's remodel.

Ask your boy Van how much of the tax payers money he wasted to send his lackey's down to the border on National Guard aircraft. I know it's SUPER important to have a Midway City Sanitary District Rep. and Councilmembers from Westminster and Garden Grove down there, but did they really need to be flown in on military helicopters? Didn't think so...

Oh yea, here's one more to look into taxpayer advocate that you are. How much of the taxpayers dollars did Van waste for the flight down last Monday night to the OCGOP meeting just to get smacked down?

cra republican said:

Well, my rough estimation for having Janet on the 5th Floor cost our tax payers approximately $5 million dollars in less than a year!(past pork barrel spending of $1 million for pet projects, Anteater park project, welfare office in little saigon,.........and the future $2.5 million westminster bridge. etc..)

"Allocated" bond money is technically a borrowed money that still needs to be paid back by our tax payers........... all Janet's office workers are brain washed to spend the money that we don't have.... this is the reason why California is in $20 billion RED.

Vote No to Spend Spend Janet!

cra republican said:

Now days, you can buy someone a condo with $150,000 dollars.

What did Janet get for $150,000 I mean with our money ? I am sure she would not spend that kind of her own money for her home furnishings!

Vote NO to "unlimited credit card mentality" Janet!

Better Pay Up said:

Cuong, you are a riot, you should really stop by on open mic night at the improv, you may be able to make a couple bucks with this routine. I've responded to everyone of your questions, yet you refuse to answer/acknowledge mine.

If you're gonna chastise Janet's office, you better spread it around to everyone else on the 5th floor, everyone in Sacramento (including our Glorious and Revered Leader Van Tran) and in Washington. Or is Janet responsible for the downturn in the entire US economy too?

You better own up.

Better Pay Up said:

A Condo, for $150,000, in Orange County? HA! HA HA! Cuong you crack me up! Is that the Dina Nguyen special these days? I've heard rumors around town about how she runs her "businesses" but that's too much.

Vote NO on utterly absurd CRA REPUBLICAN

cra republican said:

Better pay up. I hope you are not receiving the county check for spending time on this blog at the 5th Floor.

I want to know how many Janet's campaign workers are on the county's payroll (another wasteful practice/habit by Janet).

I am not Cuong.........just Art's good old neighbor from Santa Ana.

cra republican said:

Whoops, I forgot, Expensive Janet don't care for our lowly people from Santa Ana............my friend's condo was just sold for close to $150,000 on short sale.

Vote NO for Expensive Janet!

Anonymous said:

Then you might also ask how many of Van Tran's employees (paid wth taxpayer money) are spending time on this blog. We know of two at least....

cra republican said:

Still Janet has not told us how she spent our $150,000 on her office furnishings.

I do not work for Assemblyman Van Tran and I use my own time to reveal Janet's shady office deals from the 5th Floor.

Vote NO to wasteful $2.5 million bridge...... Vote No to Janet!

Better Pay Up said:

CRA(p) REPUBLICAN,

You might as well toss out your conspiracy theories of the county paying campaign workers. If you had anything you'd have already outed it by now. So you might as well move on to greener pastures.

Sophia Petrillo said:

I'm still convinced Tim Whitacre is "cra republican."

He needs to give it up. Tim is no friend to republicans like he is to the democrats. He WANTS them to win, trust me. He's working alongside Sean Mill to hammer at Supervisor Nguyen.

Ugh, the man is a scuzball. And that Mill guy isn't much of a pear either.

Better Pay Up said:

Stupid is as stupid does and the only stupid moves are coming from your camp right now. How about Dina's campaign website, www.dinaforsuppervisor.com, good to know every Vietnamese recipient of that mailer will have a nice show.

Vote NO to bad spelling and pro gay pornography Dina!

cra republican said:

Art Pedroza is having his weekly brain seizure here again. When ever Tim's name is mentioned, he goes absolutely nuts!

Vote NO to "nut case"/Obama supporter Art

Vote No to "losing team" Janet

I see the problem Art.... you are really occupied with indecent thoughts for 24hrs a day.

Make a another run for the border tonight and buy more expired medicine.
