Attorney General Dismisses Grindle's Retaliatory Complaint Against Trung Nguyen
By Matthew Cunningham | 01/04/08 | 02:27 PM EDT | 0 Comments
That was fast.
On December 4, Shirley Grindle filed a complaint against Supervisor candidate Trung Nguyen. Grindle was candid about the retaliatory nature of her complaint -- an abuse of the campaign finance enforcement system for the prupose of indirectly taking a swing at her nemesis, Mike Schroeder.
Grindle lamely tried to compare the Trung Nguyen campaign's inadvertent violations with Sup. Janet Nguyen's illegal legal defense.
In a January 2 letter, Senior Assistant Attorney General Gary W. Schons tells Grindle the AG is declining to pursue the complaint and concludes with a scathing rebuttal of Grindle's comparison of the Trung and Janet violations:
Well, Ms. Grindle certainly didn't do Sup. Janet Nguyen any favors with this intemperate, unnecessary complaint: she's guaranteed the big, bold headline Attorney General: Janet Nguyen "violated both state and county law" will be splashed across anti-Janet hit pieces in a few months.

"I know from your letter you are concerned about 'equal justice' in light if the action taken by this office and the FPPC against County Supervisor Janet Nguyen for somewhat related state and county campaign finance violations. The two situations are starkly different. First, the Janet Nguyen campaign affirmatively solicited illegal campaign contributions into an illegal account. There was no prompt realization or acknowldgement of the violations of both state and county law and no prompt refunds were made. Indeed, it was only after a complaint was raised that the Janet Nguyen campaign acknowledged its error. Her campaign's acts violated both state and county law. It is a fact that Ms. Nguyen's campaign promptly conceded error once a complaint was raised, returned the illegal contributions and cooperated with both this office and the FPPC. Ms. Nguyen's campaign stipulated to violations of state and county law and agreed to pay a stipulated fine to the state and the County of Orange. This acknowledgment of wrongdoing and cooperation were reflected in the level of fines imposed. That said, the two situations are simply not comparable.
I hope this letter adequately addresses your complaint to this office.Somehow, I doubt it will.
